Terms of Sale

These Terms of Sale ("Terms of Sale") apply to any subscription to a paid scorexact Service offer, published by Mantisnap, sole trader, SIRET 50981295400030, registered at 8 bd Déodat de Séverac, 31300 Toulouse, France (the "Publisher").
These Terms of Sale supplement the Terms of Use, which also apply to all users of the Service. Upon subscribing to a paid offer, the user (the "Customer") acknowledges having read and accepted these Terms of Sale prior to any payment.
Article 1 — Reminder of the nature of the Service
The Customer expressly acknowledges that scorexact is a statistical analysis tool providing informational insight into the intensity of football matches in progress, and not a tipster or betting advice service. The Customer understands that subscribing to a paid offer grants access to extended analysis and alert features, and does not in any way constitute the purchase of a guarantee of outcome or winnings (see Article 6 of the Terms of Use).
Article 2 — Offers and pricing
2.1 Trial period
Every new sign-up benefits from a 7 (seven) day free trial, granting access to the features described on the Site at the time of sign-up (in particular, a limited number of detailed alerts). No payment card is required to start the trial.
2.2 scorexact Pro offer
At the end of the trial period, the Customer may subscribe to the scorexact Pro offer, granting unrestricted access to all Service features, under one of the following plans:
- Monthly subscription: 19.90 € (all taxes included) / month
- Annual subscription: 149 € (all taxes included) / year
The prices in effect are those displayed on the Site at the time of subscription. The Publisher reserves the right to change its pricing at any time; the new pricing will only apply to subscriptions or renewals occurring after the change, and the Customer will be informed in advance of any price increase applicable to their ongoing subscription upon renewal.
2.3 Currency and taxes
Prices are stated in euros. VAT exemption under Article 293 B of the French Tax Code — prices are not subject to VAT.
Article 3 — Payment terms
Payment is made by credit card via the secure payment platform Stripe. The Publisher does not store any of the Customer's banking data; such data is processed directly and exclusively by Stripe, in accordance with its own terms and the PCI-DSS security standard.
The monthly or annual subscription fee is charged automatically on the date of subscription, and then at each renewal date (monthly or annual depending on the chosen plan), unless cancelled beforehand by the Customer in accordance with Article 5.
Article 4 — Automatic renewal
The Monthly and Annual subscriptions are subscriptions with no fixed commitment period, automatically renewed at each due date (monthly or annual depending on the plan subscribed to), unless cancelled by the Customer before the renewal date.
Article 5 — Cancellation
The Customer may cancel their subscription at any time, without justification or fees, directly from their personal account on the Service, or by contacting the Publisher at contact@scorexact.com.
Cancellation takes effect at the end of the period already paid for (month or year, depending on the plan): the Customer continues to benefit from scorexact Pro access until that date, with no further charges thereafter.
Article 6 — Right of withdrawal
In accordance with Article L.221-18 of the French Consumer Code, the consumer Customer is in principle entitled to a 14 (fourteen) day period to withdraw from a distance subscription.
However, in accordance with Article L.221-28 13° of the French Consumer Code, the Customer expressly acknowledges and agrees, by checking the box provided for this purpose at the time of subscription, that performance of the Service begins immediately upon subscription, and thereby explicitly waives their right of withdrawal, insofar as access to scorexact Pro features is made available immediately.
In the absence of such express acceptance, the statutory 14-day withdrawal period applies.
Article 7 — No refund for periods already started
Except as otherwise required by law or by a one-off commercial decision of the Publisher, no refund, in whole or in part, will be issued for a subscription period already started, including in the event of cancellation during a month or year already underway.
Article 8 — Liability
The provisions of Article 6 of the Terms of Use (Limitation of liability) apply in full to these Terms of Sale. In particular, the Publisher shall not be held liable for decisions made by the Customer based on information provided as part of their subscription, nor for any resulting financial losses.
Article 9 — Complaints and mediation
For any complaint, the Customer may contact the Publisher at contact@scorexact.com. Failing an amicable resolution within a reasonable time, and in accordance with the provisions of the French Consumer Code relating to mediation, the consumer Customer may freely refer the matter to the following consumer mediator: Médiation de la Consommation & Patrimoine (MCP), 12 square Desnouettes, 75015 Paris, France — online request: mcpmediation.org.
Article 10 — Governing law and competent jurisdiction
These Terms of Sale are governed by French law. In the event of a dispute, and after an attempt at amicable resolution (in particular via the mediator referred to in Article 9), the competent French courts shall have sole jurisdiction.
